Social Security processed 236,112 benefits for the birth and care of minors in the first six months of 2022, of which 112,259 corresponded to the first parent, usually the mother, and 123,853, to the second parent, usually the father.


Spending on childbirth and child care benefits between January and June this year was 1,596.5 million euros. In 2021, this figure stood at 1,369.1 million, which represents an increase of 16.6%.

The childbirth and care benefit, which replaced the old maternity and paternity benefits, entered into force on January 1, 2021 and has meant the complete equalization of both. Currently, the leave is 16 weeks for both parents and is recognized as an individual and non-transferable right. Of the 16 weeks, six of them must be enjoyed immediately after childbirth or a judicial or administrative resolution in cases of adoption, guardianship or foster care. The rest of the time can be arranged in successive periods.

The amount of these benefits is equivalent to the contribution base for the month prior to childbirth, adoption, guardianship or foster care, and is paid directly by the National Social Security Institute (INSS) during the weeks that the permit lasts.

By autonomous communities, the largest number of benefits for childbirth and child care has been recognized in Andalusia (42,206), Catalonia (42,073), Madrid (40,987) and the Valencian Community (23,770).

The National Institute of Social Security offers the possibility of requesting the birth benefit electronically, through the Tu Seguridad Social portal (https://sede.seg-social.gob.es/) and through the https form: //procedures.seg-social.es/access/provision-birth-care-minor.html

Successive rest periods for childbirth or care of the minor can also be requested electronically, if the parents choose to divide the period.

Leave of absence for child care, foster minor or relative

On the other hand, the number of discharges registered in the first half of the year was 17,140, ​​of which 14,839 corresponded to women, 86.6%, and 2,301 to men, which is equivalent to 13.4%.

The number of leaves of absence has been reduced by an average of 22.7% compared to the same period in 2021.

Madrid (4,088), Catalonia (3,319), Andalusia (2,480), the Valencian Community (2,222), and the Basque Country (2,567) are the autonomous communities with the most leaves of absence processed.

In all the autonomous communities there have been fewer exceedances than last year. The main decreases in the first half were in Cantabria (-23.0%), Madrid (-22.9%) and Aragón (-22.6%) and Castilla y León (-22%).

Male and female workers may request leave to care for foster children or minors or to care for other family members. The first three years of leave to care for a foster child or minor are considered the effective contribution period for the purposes of Social Security benefits for retirement, permanent disability, death and survival, maternity and paternity.
